Mediation information is strictly confidential unless criminal activity is revealed. All proceedings are private, allowing for much better communication between everyone. Therefore, the parties are better apt to "self-determine" an agreeable outcome without the expense and stress of a Judge or Arbitrator determination environment. In Mediation, the parties themselves determine the outcome. Many Insurance Policies, Contracts, and Employment Agreements currently require Mediation as the first step in Alternative Dispute Resolution. And well they should! Mediation is effective in almost all manner of disputes. In fact, Mediation is successful in about 85% of all cases. Mediation is cost effective and is more likely to provide a resolution that will preserve relationships. Mediated agreements are far more likely to be adhered to and to last.
